General Conditions of Use

1. Identifying data:

In compliance with the provisions of article 10 of Act 34/2002 of the 11th of July regarding the Services of the Information Society and E-Commerce, the following data will be provided: the owner of this web domain, www.bellalola.cat, is Laia Vallès (henceforth referred to as “Bella Lola”), whose address for this purpose is Carrer Mig nr.16 in Vila-robau (Girona, Spain), zip code 17475, and VAT code M-40.351.297 and contact e-mail: hola@bellalolabikinis.com.

2. Users:

The access and/or use of www.bellalola.cat confers on the person using it the condition of user (henceforth referred to as “the User”), which implies the acceptance of the General Conditions of Use reflected on this page concerning the access and/or use. The above-mentioned Conditions apply regardless of the General Conditions of Contracting that might be enforceable.

3. Use of the portal:

‘www.bellalola.cat’ provides access to a wide range of information, services, programmes or data (henceforth, “the Contents”) on the Internet belonging to Bella Lola or its associates, to which the User may gain access. The User accepts full responsibility for their use of www.bellalola.cat. This responsibility extends to any registration that might be necessary to access specific services or contents. In any such registration, the User shall be responsible for providing true and lawful information. As a consequence of such registration, the User may be provided with a password for which he or she will be responsible, undertaking to make diligent and confidential use of it.

The User undertakes to make proper use of any contents and services (such as for example, discussion forums or news groups) that Bella Lola offers or could offer through the www.bellalola.cat, and not to use these to, including without limitation, (i) practise any acts that are unlawful, illegal or in breach of good faith and public order; (ii) disseminate contents or propaganda with a racist, xenophobic or pornographic-illegal nature, justifying terrorism or infringing human rights; (iii) cause any damage to the physical and logical systems of Bella Lola, of its associates, suppliers, customers or any natural or legal third parties, introduce or disseminate I.T. viruses or any other physical or logical systems which may cause the aforementioned damage on the network; (iv) attempt to access and where applicable use the electronic mail accounts of other users and modify or manipulate their messages. Bella Lola reserves the right to remove any remarks and contributions which infringe respect for personal dignity, which are against the law, or which in its opinion are not appropriate for publication. In any event, Bella Lola will not be responsible for any opinions given by users through forums or other participation systems.

4. Data protection:

Bella Lola complies with the directives of Organic Act 15/1999 dated the 13th of December on Personal Data Protection, and Royal Decree 1720/2007 dated the 21st of December enacting the Regulations developing the Organic Act and other legislation in force at any time, and shall make sure proper use and treatment of the user’s personal data is made. To this end, it shall inform the User of the existence and acceptance of the specific conditions for treatment of their data in each case along with each form collecting personal data, in the services that the User may request from Bella Lola, informing the User of the responsibility for the file created, the address of the person responsible, the possibility of making use of their rights of access, rectification, cancellation or opposition, the purpose of the treatment and any communication of data to third parties, where applicable.

Bella Lola is furthermore making known hereby that it complies with Act 34/2002 dated the 11th of July, on Services for the Information Society and Electronic Commerce and shall request their consent for processing their electronic mail.

5. Intellectual and industrial property:

Bella Lola, either in its own right or as assignee or licensee pursuant to the consent given by its associates, is the owner of all the intellectual and industrial property rights of www.bellalola.cat, as well as of the contents of these (for announcement purposes, illustrations, sound, audio, video, software or texts; trademarks or logotypes, combinations of colours, structure and design, selection of materials used, computer programs required for its operation, access and use, etc.), owned by Bella Lola or by its associates or licensors. All rights reserved. Pursuant to what is laid down in articles 8 and 32.1, paragraph two, of the Spanish Intellectual Property Act, any reproduction, distribution and public communication, including the system for making this available, of all or part of the contents of this web page, for commercial purposes, on any support and by any technical means, is forbidden without the consent of Bella Lola. The User undertakes to respect the Intellectual and Industrial Property rights held by Bella Lola. He or she may view the items on www.bellalola.cat and even print these, copy them and store them on the hard disk of their computer or on any other physical support on condition that this is only and exclusively for their personal and private use. The User shall refrain from removing, altering, eluding or tampering with any protection device or safety system that might be installed on the web pages of Bella Lola.

6. Disclaimer of guarantees and liability:

Bella Lola accepts no liability, under any circumstances, for any damages of any kind that might be caused by, including without limitation, any errors or omissions in the contents, lack of availability of the portal or transmission of viruses or malicious or harmful programs in the contents, in spite of having implemented all the technological measures required for avoiding this.

7. Modifications:

Bella Lola reserves the right to make, with no prior notice, any modifications that it may deem fit to www.bellalola.cat, being able to change, remove or add both the contents and services granted through this and the way these are presented or located on this web page.

8. Links:

In the event of www.bellalola.cat having links or hyperlinks to other Internet web pages, Bella Lola will not have any kind of control over said websites and contents. Under no circumstances shall Bella Lola assume any responsibility for the contents of any link belonging to an outside web site, nor shall it guarantee the technical availability, quality, reliability, accuracy, amplitude, truthfulness, validity and constitutionality of any material or information contained in any of such hyperlinks or other Internet sites. Likewise, including these external connections shall not imply any kind of association, fusion or participation with the concerns connected, except insofar as this involves the associates of Bella Lola whose relationship with Bella Lola is established in the by-laws of the association.

Bella Lola reserves the right to refuse or withdraw access to its web page and/or the services offered with no need for any prior notice, at its own request or that of a third party, for any users not complying with these General Conditions of Use.

Bella Lola shall pursue any non-compliance of these conditions as well as any improper use of this web page, exercising any civil and criminal proceedings to which it may be lawfully entitled.

Bella Lola may modify the Conditions of Use set out here at any time, being duly published as appearing herein. The current validity of said Conditions shall depend on their announcement and these shall be in force until they are modified by others, duly published.

12. Applicable legislation and jurisdiction:

The relations between Bella Lola and the User shall be governed by current Spanish legislation. Any disagreement shall be submitted to the Courts of the city of Gerona (Catalonia) Spain.

13. Use of cookies:

Bella Lola uses cookies to facilitate the User’s navigation on www.bellalola.cat. Cookies are small units of data stored on the hard disc of your computer by your browser that are necessary for using our website. Bella Lola uses them to gain a better understanding of how this web page is used and to allow improved navigation.
